Terms of Service

1. Agreement to Terms

By accessing or using the R&D Rental website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and O. Price of R&D Rentals & More regarding your use of our equipment rental services.

2. Rental Eligibility

To rent equipment from R&D Rental, you must:

  • Be at least 18 years of age
  • Possess a valid driver's license
  • Be present at pickup/delivery with valid identification
  • Provide proof of insurance coverage
  • Complete and sign a rental agreement
  • Provide a valid credit card for security deposit

We reserve the right to refuse rental to anyone we believe may be under the influence of drugs or alcohol, or whose physical impairment may result in unsafe equipment operation.

3. Rental Period and Returns

The rental period begins on the scheduled pickup date and ends on the scheduled return date as specified in your rental agreement. Equipment must be returned clean and in the same condition as when received, except for normal wear and tear.

Late Returns: Late returns will incur additional daily rental charges. If you need to extend your rental period, you must contact us at least 24 hours before the scheduled return date.

4. Payment and Deposits

Payment: Full payment is required before equipment is released. We accept major credit cards and cash payments.

Security Deposit: A security deposit is required for each rental. This deposit will be held on your credit card and released upon return of equipment in satisfactory condition. The deposit may be applied toward repair costs for any damages incurred during the rental period.

Cancellation Policy: Cancellations must be made at least 24 hours in advance for a full refund. Cancellations within 24 hours may be subject to a cancellation fee.

5. Equipment Use and Care

You agree to:

  • Use the equipment properly and only for its intended purpose
  • Maintain the equipment in good working condition
  • Supply appropriate fuel and oil as specified
  • Not remove equipment from the agreed-upon location without prior written approval
  • Not sublease or allow unauthorized persons to operate the equipment
  • Report any damages or malfunctions immediately

6. Risk of Loss and Insurance

You bear the entire risk of loss, theft, destruction, or damage to the equipment from any cause whatsoever while the equipment is in your possession. You are responsible for equipment while in your possession and should maintain adequate insurance coverage.

You must notify us in writing within 5 days of any loss or damage. You will be responsible for the full replacement cost of damaged or unreturned equipment.

7. Liability and Indemnification

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, R&D RENTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES OR RENTED EQUIPMENT.

Indemnification: You agree to indemnify and hold harmless R&D Rental, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the equipment or violation of these terms.

8. Disclaimer of Warranties

R&D RENTAL MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION THE DESIGN OR CONDITION OF THE EQUIPMENT, ITS MERCHANTABILITY, OR ITS FITNESS OR CAPACITY FOR ANY PARTICULAR PURPOSE. ALL EQUIPMENT IS PROVIDED "AS IS."

9. Website Usage

By using our website, you agree to:

  • Provide accurate and complete information when making reservations
  • Not use the website for any illegal or unauthorized purpose
  • Not attempt to gain unauthorized access to our systems
  • Not interfere with the proper working of the website
  • Accept that website availability may occasionally be interrupted for maintenance

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action arising out of these Terms shall be brought in the state or federal courts located in Wayne County, Michigan.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
